Prime Planet Digital Collectibles Terms and Conditions

 

By purchasing, minting, holding, or interacting with any Prime Planet digital collectible (hereafter referred to as “Prime Collectible”), you agree to the following Terms and Conditions. These terms govern your use of the Prime Collectibles and their associated content. If you do not agree to these terms, you must not purchase, mint, or interact with Prime Collectibles.

 

1. Ownership of Prime Collectibles

 

1.1 Non-IP Transfer: Purchasing or minting a Prime Collectible grants you ownership of the unique digital token on the blockchain, but it does not grant you ownership of the intellectual property (IP) rights to the associated artwork, metadata, or any other content.

 

1.2 Limited Usage Rights: You are granted a personal, non-exclusive, non-transferable, revocable license to view and display the associated artwork for non-commercial, personal use only, while you own the corresponding Prime Collectible.

 

2. Prime Planet’s Control Over Content

 

2.1 Modification and Removal of Content: Prime Planet reserves the right, at its sole discretion, to modify, update, replace, or remove any data, metadata, or content associated with Prime Collectibles at any time without notice or liability. This includes, but is not limited to:

• Modifying the visual artwork or metadata.

• Removing the associated content entirely.

 

2.2 No Guarantee of Perpetual Access: Prime Planet does not guarantee the perpetual existence or availability of the artwork or metadata associated with Prime Collectibles.

 

2.3 On-Chain and Off-Chain Hosting: Prime Planet may host associated content using centralized, decentralized, or hybrid methods. Content hosted off-chain may be subject to removal or alteration at the discretion of Prime Planet.

 

3. Intellectual Property Rights

 

3.1 Retention of IP by Prime Planet: Prime Planet retains all IP rights, title, and interest in and to the artwork, designs, trademarks, and other associated content of Prime Collectibles.

 

3.2 Prohibited Uses: Without express written permission from Prime Planet, you may not:

• Use the associated artwork or content for any commercial purposes.

• Create derivative works based on the associated artwork or content.

• Modify, reproduce, distribute, or publicly display the associated artwork or content in any manner.

 

4. Not an Investment Opportunity

 

4.1 No Financial Advice or Guarantees: Prime Collectibles are designed solely for enjoyment and as digital collectibles. They are not advertised or offered as investment opportunities, securities, or any form of financial instrument.

 

4.2 Risk of Loss: The value of Prime Collectibles is highly speculative and may fluctuate. By purchasing or minting a Prime Collectible, you acknowledge and accept the risk that its value may decrease or become worthless. You should only participate if you can afford to lose the amount spent.

 

5. Disclaimers and Limitations of Liability

 

5.1 No Warranties: Prime Collectibles are provided “as is” without warranties of any kind, express or implied. Prime Planet does not warrant or guarantee the value, availability, or functionality of Prime Collectibles or their associated content.

 

5.2 Limitation of Liability: To the fullest extent permitted by law, Prime Planet shall not be liable for any damages, losses, or claims arising from:

• The removal, alteration, or unavailability of content associated with Prime Collectibles.

• The purchase, minting, sale, or transfer of Prime Collectibles.

• Any third-party platforms, wallets, or marketplaces used to interact with Prime Collectibles.

 

6. Amendments

 

Prime Planet reserves the right to update or amend these Terms and Conditions at any time, with updates effective immediately upon posting. Continued interaction with Prime Collectibles constitutes acceptance of the revised terms.

 

7. Governing Law

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of Spain.
